For the second time the Court has ruled that the written word of law of Obamacare is inconsequential and that the Court can reach decisions not based on written law but on the personal wrong opinions of a majority of Judges. Every member of the court who voted for this travesty should be impeached. Roberts has shown his true colors; Roberts is a socialist! Those who believe in the fiction of the constitution as a “living document”, in other words that judges have the right based on personal opinion to read whatever they like into law do not understand democratic principles or concepts of jurisprudence as written in the Constitution.
America is a republic. Based on the principle that we are not governed by opinion of either the majority or by those of the Judiciary but by a set of written laws; our Constitution. Robert’s and his associates have turned our nation into a democracy…more clearly mob rule. We can now dispense of the Constitution and Bill of Rights, because our Supreme Court has ruled that they and only they are the interpreters of English and that their decisions need not comply with the written word.
As Seneca said. “It is proof of a bad cause when it is applauded by the mob”
Article I Section 1: All Legislative Powers herein granted shall be vested in a congress of the United States which shall consist of a Senate and House of Representatives”. There is nothing ambiguous about this, all laws are made by congress, not by the Court.
Article II Section 1 Paragraph 1: “The executive power shall be vested in a president of the United States of America. Section I paragraph 9: The oath: “….and will to the best of my Ability, preserve, protect, and defend the Constitution of the United States”. Very clear is it not?
Article III Section 2 last sentence: “ In all other cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under regulations as the Congress shall make”. Congress made the law. Judges do not have the authority to overturn the actions of our elected representatives.
What has the court done in both cases? They made law! What the Constitution clearly states is that the Court cannot make law.
